Under the New Regulatory Framework, ComReg is charged with assessing the relevant electronic communications markets in Ireland. This process is based on a list of markets contained in the
Recommendation on Relevant Products and Service Markets
which was adopted in 2003. ComReg uses the list of 18 recommended markets to assess the level of competition. Markets must be defined and analysed in accordance with the principles set out in the Recommendation and under the Framework Directive. Where ComReg finds that there is evidence of significant market power of one or more operator, remedies must be imposed in order to address the competition problem. The European Commission is preparing a new Recommendation of relevant markets and it is expected that there will be fewer recommended markets to be analysed.
