General Information about Broadcasting

The main role of the broadcasting section of ComReg is to:

  • Plan and co-ordinate internationally, in co-operation with other stakeholders, broadcast transmission networks for Ireland
  • Input into national broadcasting policy
  • Develop and issue licences for terrestrial TV and radio broadcast.
  • Devise new licensing regimes and draft appropriate secondary legislation
  • Monitor and enforce compliance with licence terms and conditions.


Under the 1926 Wireless Telegraphy Act the possession and operation of apparatus for wireless telegraphy requires the possession of a licence. ComReg issues licences in the broadcasting area in accordance with this Act (equipment), the Broadcasting Authority Act 1960 (RTÉ), the Radio and Television Act 1988 (BCI) and the Broadcasting (Amendment) Act 2007 (Digital Broadcasting).

 
Main legislation that governs broadcasting in Ireland
Wireless Telegraphy Act, 1926:

Under this act the possession and operation of apparatus for wireless telegraphy requires the possession of a licence. ComReg issues licences in accordance with this Act (equipment) and the 1988 Broadcasting & Wireless Telegraphy Act.

Broadcasting Authority Act, 1960:

This act enabled the establishment of Radio Telifís Éireann (RTÉ) and also extended and made amendments to the 1926 Wireless Telegraphy Act. It is the Act under which RTÉ holds its analogue broadcasting licence for radio and television.

Radio and Television Act, 1988:

This act established the Independent Radio and Television Commission (IRTC), now the Broadcasting Commission of Ireland. The function of the IRTC was to enter into contracts for the provision of sound broadcasting services and a television programme service additional to services provided by Radio Telefís Éireann (RTÉ). It aslo made ammendments to the Wireless Telegraphy Act, 1926. The Act of 1988 is the Act under which the BCI holds a licence from ComReg in respect of the frequencies used by the independent radio and television operators.

Broadcasting Act, 2001:

The act conferred more functions on the IRTC and also renamed the IRTC as the Broadcasting Commision of Ireland (BCI). Telifís na Gaeilge was established and the act was also the first piece of legislation issued which provided a framework for Digital Terrestial Television (DTT).

Broadcasting (Amendment) Act 2007:

 The Act sets out a licensing framework for the development of digital terrestrial television (DTT) and digital radio services in Ireland. It also amends the public service remit of RTÉ to allow it to broadcast to Irish communities living outside the island of Ireland.
