| Q | Can you please clarify the spectrum band referred to in the first line of Table 2 at paragraph 6.7 of ComReg 09/99. The table states 825-890/935-960MHz (900MHz Band is planned for release circa 2013. | ||||||||

The purpose of section 6.7 of Consultation 09/99 is to provide visibility to stakeholders of upcoming spectrum releases in bands other than 900 MHz and 1800 MHz. The first two lines of Table 2 should be deleted as ComReg’s current position in relation to the 900 MHz and 1800 MHz band is set out elsewhere in Consultation 09/99.

| Q | Will the Spectrum Usage Fee (SUF) be impacted in any way by the final outcome of the proposed auction? | ||||||||
| A | ComReg proposes to set the SUF in advance of the auction and under ComReg’s proposals in document 09/99 the SUF would not be impacted in any way by the final outcome of the auction – irrespective of whether demand does or does not exceed supply. | ||||||||
| Q | My interpretation of the consultation proposals is that the SUF will be set at €1.8m per annum per 2 x 5MHz block. | ||||||||
| A | That is ComReg’s current proposal in document 09/99. | ||||||||
| Q | If the final price exceeds the reserve price the excess must be paid within 3 years of the auction and the excess could not be recovered through increased SUFs. |

| A | ComReg proposes in document 09/99 to set the SUF in advance of the auction and under these proposals the SUF would not be impacted in any way by the final outcome of the auction. Chapter 13 of ComReg 09/99 details ComReg’s Proposed Auction Fees and this chapter proposes that; "At least 50% of the excess of a bidder’s winning price over the reserve price will need to be paid before any licence is issued, within the timeframe set by the auction rules. Successful bidders choosing to defer no more than 50% of the excess of their wining price over the reserve price will be required to pay the outstanding amount, in at least equal payments in the first, second and third year of the licence, at an interest rate of 12%."
