Legal Advisor (Wholesale Division)

Role Purpose

The primary role of the Legal Advisor (Band 2 Zone 2) in the Wholesale Division is to provide expert, solution-focused legal advice on a range of regulatory and competition issues within ComReg’s remit including the implementation and operation of the EU regime governing the relevant sectors.

The role reports to the Legal Manager of the Wholesale Division. The Legal Advisor works within a multi-disciplinary environment, which includes business analysts, industry experts, engineers, accountants, economists and other lawyers.

Role Description

  • Provide clear, concise, practical and strategic legal advice to inform and guide the Wholesale Division, the Commission and its staff by identifying the key legal issues, the available options, and the associated legal risks;
  • Review key documentation and identify legal weaknesses and/or necessary changes. Review documentation prepared by external consultants, prior to publication;
  • Draft elements of public consultation documents including regulatory impact assessments, decision instruments (in particular in relation to market analysis and pricing), dispute resolution determinations, notifications and opinions of non-compliance and legislation;
  • Form a considered view as to whether any proposed regulatory measure is supported by the relevant facts and consistent with applicable law and whether the administrative process leading to the proposed measure was properly conducted;
  • Prepare legal briefs for external lawyers, particularly in the context of litigation cases and managing the ongoing provision of external advice in a cost effective way;
  • Provide analysis and input on any proposed National or EC legislation impacting ComReg’s responsibilities;
  • Manage litigation as required, both defence and prosecution affidavits, expert reports and other substantive input for use in the litigation (submissions, motion papers, etc.);
  • Contribute to organisation-level legal and regulatory policy issues, including by participating in cross-Divisional advisor meetings led by ComReg’s General Counsel;

 

Qualifications and experience:

  • Be enrolled and admitted as a Solicitor or Barrister in the State with 6+ years post qualification experience;
  • Experience of working in top tier legal practice, or advising a sector-specific regulator or similar statutory body;
  • Experience of advising on or an in-depth understanding of the policies which underpin sector-specific regulation, including market liberalisation and the promotion of competition;
  • Specific qualifications in or publications on public administrative law and/or competition law, and/or regulatory law;
  • Experience of advising on EU, regulatory and competition law as well on public administrative law as it pertains to the electronic communications sector;
  • Experience in drafting and/or reviewing all aspects of public consultation papers, regulatory decision instruments, or legislation;
  • Litigation experience, particularly in the High Court or District Court (including litigation for/against the State or public bodies, statutory appeal regimes and judicial review);
  • Experience of advising on market analysis and pricing decisions desirable;

ComReg Senior Manager Regulatory Governance (Wholesale Division)

ComReg’s Wholesale Division is mainly responsible for the regulation of certain wholesale electronic communications markets (fixed/mobile telecommunications, broadcasting transmission) in Ireland. ComReg is required to conduct periodic market reviews of such markets in order to assess the extent of competition within them and whether ex ante regulatory intervention is required. Additionally, ComReg has responsibility for ensuring compliance with competition law in the electronic communications sector on an ex post basis.

 

Role Purpose:

The primary role of the Senior Manager, Regulatory Governance will be to lead the process to potentially mandate a governance structure for Eircom, using ComReg’s statutory powers, to evaluate any voluntary proposals that may arise and to lead ComReg’s oversight of any new governance structures that may be put in place. The role will report to the Director of ComReg’s Wholesale Division.

 

Role description:

  • Responsible for delivering a consultation and if appropriate a decision on new governance structures for Eircom Ltd (“Eircom”);
  • Leading the drafting of relevant documentation;
  • Potentially evaluating any proposals from Eircom in respect of its governance structures;
  • Liaising with relevant stakeholders including industry and European Commission;
  • Co-ordinating a wide group of ComReg staff including those legal, economic financial and engineering expertise;
  • Monitoring the implementation of any new governance structures;
  • Ongoing monitoring and evaluation of such governance structures;
  • Liaison with ComReg colleagues in related operational and compliance issues;
  • Leading a small team;
  • Managing relevant external advisors.

 

Experience/knowledge;

  • A relevant third level qualification.
  • At least 5 years relevant post graduate work experience at a senior level.
  • Experience working in a regulatory environment, whether in a governmental organisation, consultancy or corporate entity.

ComReg Manager (2:2) Products Strategy Manager (PSM).

The Role

The work of the Wholesale Products team, in ComReg’s Wholesale Division, includes consideration, from a regulatory perspective, of both operational and strategic aspects of issues that impact competition in, and the functioning of, regulated markets. The Products Strategy manager will work alongside the Products Operational manager and lead the Wholesale Products Strategy team.

From their respective perspectives, the Wholesale Products Operational and Wholesale Products Strategy teams will consider a wide range of market related issues such as the operation of regulatory remedies in place in regulated markets. This includes the provision of wholesale regulated products and services and related issues such as the quality and effectiveness of the wholesale regulated services offered to Telecom’s Operators, for example.

There is considerable ongoing engagement between ComReg and Telecoms Operators on the regulatory aspects of the development and operation of all aspects of regulated wholesale products. The Products Strategy manager will take a take a strategic and policy oriented view and determine the implications for regulation of issues arising from the development and use of regulated wholesale products.

The Products Strategy manager will also consider emerging issues and developments, including technical developments, which could give rise to competition problems and/or impact on Telecom’s Operators consuming wholesale regulated services in order to provide wholesale services or using wholesale inputs in order to provide products and services in downstream markets.

The Products Strategy Manager will also provide support to the analysis of regulated markets, including the preparation of ComReg consultations and provide support for ComReg’s regulatory compliance activity work.

The responsibilities for this role will be:

Provide support to the Market Analysis team in order to assist in the analysis of regulated markets.

Oversee the progress and the activity of Telecoms Operators from a regulatory perspective including actions arising on foot of ComReg Decisions in regulated markets.

Preparation and presentation of draft positions and proposing draft remedies to competition problems during ComReg’s analysis of regulated markets.

Analysis, including Technical analysis, of the implications including regulatory implications of developments in the Telecom Sector.

Candidate Qualifications and Background

Essential experience/knowledge

  • A degree in a telecommunications related area or similar;
  • 5 – 7 years post-graduate work experience within a relevant organisation;

Analyst: Wholesale Division

The Role

A vacancy has arisen for an Analyst, in the Wholesale Division. The Products team is responsible for the oversight of the development and maintenance of Wholesale Regulated Access Products (RAP) in the context of Eir’s compliance with its regulatory obligations.

 

The team engages with Operators on issues arising from the development, supply and maintenance of Next Generation Access (NGA) and Current Generation Access (CGA) RAP products and services such as Bitstream, Local Loop Unbundling (LLU), Single Billing Wholesale Line Rental (SBWLR), Leased Lines etc.

 

The team oversees the treatment of operators regarding the supply of  Wholesale RAPs thereby ensuring competition in the telecommunications market is not distorted.

 

The work of the Analyst involves the detailed analysis of wholesale telecoms products and processes from a range of perspectives including process, regulatory compliance, systems, technical and market impact perspective, in support of the Products team’s objectives.

 

The processes being referred to are the inter operator processes which underpin the delivery and maintenance of a range of regulated wholesale telecommunications services.

 

These analyses are key inputs into ComReg decision making at both an Operational and Strategic level and therefore strong analytical and communications skills, both verbal and written, are required.

 

 

Responsibilities will include: –

  • Managing and analysing regulatory issues relating to RAP Products portfolios such as Mobile Number Portability (MNP), NGA and CGA RAPs.
  • Analysing, investigating and documenting RAP related issues as they are raised by industry or other wise come to the attention of ComReg.
  • Reviewing issues and making recommendations supported by detailed analysis of issues.
  • Engaging with industry in the area of RAP related product and process development and improvement through bilateral contacts and industry forums.
  • Provide support to the Market Analysis team as part of the review of regulated markets.
  • Assist in resolving consumer care issues as they relate to issues with Wholesale RAPs.
  • Provide advice and support to other regulators where practicable, on the basis of ComReg experience, through questionnaires, surveys, enquiries etc.
  • Assisting in producing consultation papers.
  • Working in a multi-disciplinary environment.

Essential

  • A degree in a telecommunications related area or similar. However candidates with demonstrably strong analytical skills, preferably in an engineering area, and who are willing to work in a telecommunications environment, will also be considered.
  • The ability to identify and propose solutions to systemic technical or process related issues requiring remediation.
  • The ability to work unsupervised, following issues through to completion while communicating and updating ComReg management as appropriate.
  • A high standard of verbal and oral communication skills is very important as reports and other documents can be referenced in legal actions and may be used as evidence in court.
  • Ability to work in a multi-disciplinary team
  • A key requirement of this role is a strong analytical ability the following are provided as examples:
    • The detailed analysis of process related issues resulting in   presentation and/or preparation of reports and providing documented recommendations on issues identified.
    • Consideration of issues raised by Operators regarding the operation of a RAP product and subsequent documentation of the issue and findings with a view to resolution.
    • Application of analytical skills to a technical issue relating to a regulated wholesale product, with a view to proposing solutions or making recommendations.
