{"id":91590,"date":"2016-04-26T08:48:47","date_gmt":"2016-04-26T08:48:47","guid":{"rendered":"http:\/\/comreg.ie.grigore"},"modified":"2021-10-01T18:16:47","modified_gmt":"2021-10-01T18:16:47","slug":"an-bhfuil-ceadunas-uaim","status":"publish","type":"page","link":"https:\/\/www.comreg.ie\/ga\/tionsclaiocht\/ceadunu\/ceadunu-seirbhisi-ardrata\/an-bhfuil-ceadunas-uaim\/","title":{"rendered":"An bhfuil cead\u00fanas SAR uaim?"},"content":{"rendered":"<h2><span lang=\"en\">How do I <strong>know<\/strong> if I need a PRS licence?<\/span><\/h2>\n<p><span lang=\"en\">Section 12 of the Act of 2010 states that it is an offence to provide a specified premium rate service (\u201cPRS\u201d) without a licence and all parties involved in the provision of a PRS are required to be licensed.<\/p>\n<p>To avoid any doubt, please ensure that you are aware of whether you qualify as a PRS provider and what constitutes a specified PRS from the definitions below:<\/span><\/p>\n<h3><span lang=\"en\"><strong>What is a PRS Provider?<\/strong><\/span><\/h3>\n<p><span lang=\"en\">In accordance with the <a href=\"http:\/\/www.irishstatutebook.ie\/eli\/2010\/act\/2\/enacted\/en\/html\">Communications Regulation (Premium Rate Services and Electronic Communications Infrastructure) Act, 2010<\/a>, a premium rate service provider means a person who does any, or all, of the following for gain:<\/p>\n<ol>\n<li>provides the contents of a premium rate service,<\/li>\n<li>exercises editorial control over the contents of a premium rate service,<\/li>\n<li>packages together the contents of a premium rate service for the purpose of facilitating its provision,<\/li>\n<li>makes available a facility as part of a premium rate service,<\/li>\n<li>transfers a premium rate service from a content provider to one or more electronic communications networks, or<\/li>\n<li>provides the electronic communications service over which a premium rate service is provided, or provides the electronic communications network over which a premium rate service is transmitted.<\/li>\n<p><\/span>\n<\/ol>\n<h3><span lang=\"en\"><strong>What is a Specified PRS?<\/strong><\/span><\/h3>\n<p><span lang=\"en\">In accordance with the <a href=\"http:\/\/www.irishstatutebook.ie\/eli\/2010\/act\/2\/enacted\/en\/html\">Communications Regulation (Premium Rate Services and Electronic Communications Infrastructure) Act, 2010<\/a>, a specified premium rate service is a premium rate service, other than a service which is accessed only via an international call, whereby:<\/p>\n<ul>\n<li>the service is accessed by a premium rate number (with a 15XX access code) and the price payable by the end user for each call* exceeds 25 cent** (inclusive of value added tax); or<\/li>\n<li>the service is accessed other than by means of a premium rate number and the price payable by the end user for each call exceeds 25 cent (inclusive of value added tax) for each call; or<\/li>\n<li>the service is :<\/li>\n<\/ul>\n<ol>\n<li>a chatline service;<\/li>\n<li>a sexual entertainment service;<\/li>\n<li>a children\u2019s service;<\/li>\n<li>a subscription service or<\/li>\n<li>operated by internet dialler software.<\/li>\n<\/ol>\n<p><em>* Call means any communication (whether voice, data, text or otherwise) which passes through an electronic communications network, whether initiated by an end user or initiated by or facilitated by a premium rate service provider, and a \u201ccaller\u201d shall be construed accordingly.<\/em><em style=\"line-height: 1.5;\">\u00a0<\/em><\/p>\n<p><em>**The 25 cent threshold is based on Eircom\u2019s charge from a standard Eircom fixed line.<\/em><\/p>\n<p>There are certain exemptions in place for a premium rate service provider who provides:<\/p>\n<ul>\n<li>a premium rate service which comprises directory enquiry services and relevant value added services that are provided using the number range 118XX; or<\/li>\n<li>on-demand audiovisual media services, are exempted from acquiring a licence as the two services listed above are not classified as specified premium rate services.<\/li>\n<\/ul>\n<p>Please also read the <u>Communications Regulation (Licensing of Premium Rate Services) Regulations 2012<\/u> for further information as they contain the conditions attached to a licence.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>How do I know if I need a PRS licence?
