{"id":96051,"date":"2016-09-29T10:12:32","date_gmt":"2016-09-29T10:12:32","guid":{"rendered":"http:\/\/www.comreg.ie\/tionsclaiocht\/cumarsaid-leictreonach\/comhlionadh\/disputes\/?lang=ga"},"modified":"2021-10-02T13:11:33","modified_gmt":"2021-10-02T13:11:33","slug":"diospoidi","status":"publish","type":"page","link":"https:\/\/www.comreg.ie\/ga\/tionsclaiocht\/cumarsaid-leictreonach\/comhlionadh\/diospoidi\/","title":{"rendered":"D\u00edosp\u00f3id\u00ed"},"content":{"rendered":"<h2><span lang=\"en\"><strong>Disputes<\/strong><\/span><\/h2>\n<p><span lang=\"en\">ComReg, at the request of a party, may initiate an investigation into a Dispute in connection with obligations under the following Regulations and Acts:<\/span><\/p>\n<ul>\n<li>Regulation 31 of the Framework Regulations;<\/li>\n<li>Section 57 of the Communications Regulation Act;<\/li>\n<li>Regulations 4, 5, 6, 7, 8 and 9 of the Broadband Cost Reduction Regulations.<\/li>\n<\/ul>\n<h3><span lang=\"en\"><strong>Regulation 31 of the Framework Regulations<\/strong><\/span><\/h3>\n<p><span lang=\"en\">In the event of a Dispute arising between two undertakings in connection with obligations under Regulation 31(1) of the Framework Regulations, ComReg will initiate an investigation of the dispute and make a determination to ensure compliance with the Regulations. In accordance with Regulation 31(3) ComReg has published its dispute resolution procedure, see ComReg Document No. <a title=\"This link will open in a new window\" href=\"https:\/\/www.comreg.ie\/?dlm_download=response-to-consultation-document-no-0985-dispute-resolution-procedures-framework-regulations\" target=\"_blank\" rel=\"noopener noreferrer\">10\/18R<\/a>. All investigations and determinations made under Regulation 31 will be carried out accordance with this procedure.<\/span><\/p>\n<h3><span lang=\"en\"><strong>Section 57 of the Communications Regulation Act<\/strong><\/span><\/h3>\n<p><span lang=\"en\">In the event of a Dispute arising between two network operators in connection with infrastructure sharing, pursuant to Section 57 of the Communications Regulation Act, ComReg will initiate an investigation to resolve the dispute. In accordance with Section\u00a057(6) of the Act, ComReg has established a Dispute Resolution Procedure see ComReg Document No. <a title=\"This link will open in a new window\" href=\"https:\/\/www.comreg.ie\/?dlm_download=information-notice-resolution-procedures-developed-taking-account-of-section-57-of-the-communications-regulation-act-2002\" target=\"_blank\" rel=\"noopener noreferrer\">12\/108<\/a>, which ComReg continues to maintain. All Section 57 disputes will be resolved in accordance with this procedure.<\/span><\/p>\n<h3><span lang=\"en\"><strong>Regulations 4, 5, 6, 7, 8 and 9 of the Broadband Cost Reduction Regulations<\/strong><\/span><\/h3>\n<p><span lang=\"en\">In the event of Dispute arising between a public communications network operator and a network operator or a holder of rights to use access points or in-building infrastructure, pursuant to Regulations 4, 5, 6, 7, 8 and 9 of the Broadband Costs Reduction Regulations, ComReg will initiate an investigation to resolve the dispute. In accordance with Regulation 11(4) of the Broadband Cost Reduction Regulations ComReg has established and published its dispute settlement procedure, see ComReg document No.<a title=\"This link will open in a new window\" href=\"https:\/\/www.comreg.ie\/?dlm_download=broadband-cost-reduction-regulations-dispute-process\" target=\"_blank\" rel=\"noopener noreferrer\">16\/77<\/a>, which ComReg continues to maintain.
