The EMC Directive
The EMC Directive is part of the “New Approach” series of European Directives that simplifies the procedures for placing on the market, free circulation and putting into service of electronic equipment.
This Directive (2004/108/EC) applies to all equipment placed on the market or taken into service, so that it includes systems as well as individual products. Its scope is all apparatus “liable to cause electromagnetic disturbance or the performance of which is liable to be affected by such disturbance”, although it does not apply to all products, e.g. medical, automotive, which are covered by other Directives.
Essential requirements of the Directive
Protection requirements
Equipment shall be so designed and manufactured, having regard to the state of the art, as to ensure that:
The electromagnetic disturbance generated does not exceed the level above which radio and telecommunications equipment or other equipment cannot operate as intended;
It has a level of immunity to the electromagnetic disturbance to be expected in its intended use which allows it to operate without unacceptable degradation of its intended use.
Specific requirements for fixed installations
Installation and intended use of components
A fixed installation shall be installed applying good engineering practices and respecting the information on the intended use of its components, with a view to meeting the protection requirements set out in Point 1. Those good engineering practices shall be documented and the documentation shall be held by the person(s) responsible at the disposal of the relevant national authorities for inspection purposes for as long as the fixed installation is in operation.
The CE Mark
The CE mark is required on all products within the scope of New Approach directives that are placed on the European market. The manufacturer, or the person affixing the CE mark, must ensure that it meets the essential requirements of the applicable directives before placing it on the market.
Directive 2004/108/EC was transposed into Irish law under S.I. 109 of 2007.
