ComReg has today issued a notification of non-compliance to Eircom in respect of its transparency obligations. This non-compliance relates to the failure by Eircom to publish the terms and conditions (including price) of a new wholesale “White Label” PSTN product in the manner and to the quality required by its obligations.

The Commission for Communications Regulation (ComReg) has today published its Quarterly Report for the fourth quarter (Q4) of 2007. The Report shows that Ireland has over 5 million mobile phone subscriptions. Please see attached documents for further details.

ComRegs finds that Eircom has remedied the previously notified discriminatory performance in repairing PSTN faults for other operators. This related to the period from Dec 2006 until May 2007 when Eircom’s performance in repairing OAO customers’ faults was inferior to its performance in repairing faults for its own customers.

ComReg has today (22 February) issued directions to Eircom, directing it to increase the retail minus percentage applicable to Single Billing Wholesale Line Rental (“SB-WLRâ€) from the current margin of retail minus 10% to retail minus 14%. Eircom has also been directed to give effect to the resulting amendments to wholesale prices for SB-WLR in all bills issued by Eircom to other authorised operators on and after 1 May, 2008.

ComReg wishes to announce that it has awarded four contracts to three sets of consultants, for consultancy services advising on eircom's proposed structural separation. The total value of all four contracts awarded is 712,846 euro. Oxera/Ellare has been appointed to advise on the operational impact of separation. LECG has been appointed to advise on two areas, strategic issues and regulatory pricing/accounting separation. IBI Corporate Finance has been retained to advise on corporate finance issues

The scope of the dispute concerns an alleged failure by Tesco Mobile to negotiate interconnection by virtue of a failure to negotiate Mobile Termination Rates for the provision of mobile voice call termination services.

ComReg has today confirmed that eircom have complied with the Telecommunications Tariff Regulation Order 2003 in the year 2006/07. Compliance was monitored throughout the year from February 2006 to February 2007. eircom had the scope to make increases of up to 2.5%, but in fact made aggregate decreases of 1.25%.

The Commission for Communications Regulation (ComReg) has published its Quarterly Report for the first quarter of 2007. It shows continued strong growth in Irish broadband markets. ComReg launched its initial wireless broadband scheme in 2003. This scheme promoted greater broadband competition and offered consumers greater choice in broadband provision. ComReg today publishes its market review for the fixed retail narrowband access markets. The document sets outs ComReg's findings in relation to market definition and market analysis. In addition, it imposes regulatory remedies at both the wholesale and retail level which are considered justified and proportionate. ComReg has concluded that eircom Ltd. should be designated as having SMP in the fixed retail market for lower level narrowband access to the public telephone network and in the fixed retail market for higher level narrowband access to the public telephone network.
