Eircom, per ComReg Decision D06/08, was designated with significant market power in the wholesale market for the terminating segment of leased lines. ComReg in Consultation No. 10/32 and Consultation No.11/32 consulted upon a further specification of the Price Control Obligation in the wholesale market for the terminating segment of leased lines. ComReg has now reached a final Decision on the appropriate price control and this is set out in ComReg Decision D02/12.

On Thursday 29 July 2010, the Minister for Communications, Energy and Natural Resources announced that analogue terrestrial television will be switched-off in the State in Quarter 4 of 2012. The switch-off of analogue TV services will release valuable radio spectrum that can be used for new and innovative electronic communications services and additional/enhanced television services. This freeing up of frequencies as a result of the switchover from analogue to digital terrestrial TV is commonly known as the “Digital Dividend.” ComReg has issued an Information Notice to provide an update to stakeholders on the expected availability and release of Digital Dividend spectrum and, in particular, the 800 MHz band. The information notice also outlines the next steps in relation to the 900 MHz liberalisation process.

The Commission for Communications Regulation (ComReg) has announced that the deadline for the submission of responses to its current public consultation on the Implementation of EC Decision 2008/411/EC and Introduction of Mobility to the 3400 – 3800 MHz Band has been extended to 3 September 2010. The consultation deals with the ComReg’s obligation to implement EC Decision 2008/411 EC and how its proposals to implement same will impact on licensees in the 3400 – 3800 MHz band.

The Commission for Communications Regulation (ComReg) today published details of the commitments made by Eircom Limited (Eircom) in the course of the competition for the fourth third generation mobile (3G) licence which was held in 2005. The licence was awarded in 2006 following the outcome of litigation in connection with this competition. Eircom subsequently transferred its 3G licence, along with all associated rights and obligations, to Meteor Mobile Communications Limited (Meteor) in June 2008. The Commission for Communications Regulation (ComReg) welcomes the conclusion of an agreement between Hutchison 3G Ireland Limited (3) and Tesco Mobile Ireland Limited (Tesco Mobile) such that 3's customers and Tesco Mobile's customers can now make calls to customers of each other's networks. Until now, it had not been possible for customers of 3 to make calls to Tesco Mobile customers. ComReg believes that consumers expect to be able to call any Irish network, irrespective of their choice of mobile or fixed line operator and this development removes a problem about which many consumers have complained to ComReg. This development will benefit the customers of both 3 and Tesco Mobile and will increase the level of choice available to all Irish consumers.

ComReg has today made a final determination in respect to the dispute between BT Ireland and Eircom in relation to Local Loop Unbundling (LLU) collocation at Eircom Nutley Exchange. In summary, the determination sets out that BTs request was a reasonable request for an existing LLU service and that Eircom has an obligation to meet this request for access, pursuant to Decision D8/04. The determination also sets out that Eircom is to make an offer to BT for the requested access and defines the terms associated with this offer. The full determination is published below.

The Commission for Commissions Regulation (ComReg) today published a decision in relation to the maximum charges for wholesale fixed and mobile number porting. The decision sets out that a mobile operator cannot charge in excess of 2.05 to another mobile operator when a customer moves. Similarly, a fixed operator cannot charge in excess of 4.02 to another fixed operator when a customer moves.

The Commission for Communications Regulation (ComReg) has today published the outcome of its review of the Code of Practice (CoP) for Single Billing via Wholesale Line Rental (SB-WLR). Following this review the CoP is now composed of two documents to aid consumers and the industry. One document outlines the provisions that have a legal basis and the other documents outlines the provisions that do not have a legal basis. This should help consumers to know what to expect from their operator. Please see documents below for further details.

The Commission for Communications Regulation (ComReg) has today announced that, following a request from Eircom Limited (Eircom), the deadline for Eircom to make representations or remedy the non-compliance with its non-discrimination obligation in relation to Sync Checker has been extended to 9 January 2009. The Information Notice 08/95, published 4 December 2008, which is available on the ComReg website www.comreg.ie, stated that ComReg had notified Eircom of its findings of non-compliance. Eircom was given one month to make representations or remedy the non-compliance.

The Commission for Communications Regulations (ComReg) has today amended the General Authorisation (ComReg Document Number 03/81) to provide for new legal obligations pertaining to all Authorised Persons who provide, or wish to provide, electronic communications service or electronic communications network to consumers. The new legal obligations address situations where a cessation of service to consumers is reasonably probable and include obligations to notify ComReg and consumers of such a cessation and can be found in ComReg Document Number 03/81R1 which is attached below.

ComRegs finds that Eircom has remedied the previously notified discriminatory performance in repairing PSTN faults for other operators. This related to the period from Dec 2006 until May 2007 when Eircom’s performance in repairing OAO customers’ faults was inferior to its performance in repairing faults for its own customers.

ComReg has today (22 February) issued directions to Eircom, directing it to increase the retail minus percentage applicable to Single Billing Wholesale Line Rental (“SB-WLR”) from the current margin of retail minus 10% to retail minus 14%. Eircom has also been directed to give effect to the resulting amendments to wholesale prices for SB-WLR in all bills issued by Eircom to other authorised operators on and after 1 May, 2008.

ComReg today published its Guidelines on Regulatory Impact Assessment, which set out its approach to ensuring that the overall impact of any legal obligations it imposes have been thoroughly considered and analysed.

ComReg has today confirmed that eircom have complied with the Telecommunications Tariff Regulation Order 2003 in the year 2006/07. Compliance was monitored throughout the year from February 2006 to February 2007. eircom had the scope to make increases of up to 2.5%, but in fact made aggregate decreases of 1.25%.

The Commission for Communications Regulation (ComReg) has published its Quarterly Report for the first quarter of 2007. It shows continued strong growth in Irish broadband markets. At the end of March 2007, there were 602,000 broadband subscribers in Ireland. Please see attached documents for further information.

ComReg launched its initial wireless broadband scheme in 2003. This scheme promoted greater broadband competition and offered consumers greater choice in broadband provision. Today ComReg has published new guidelines which will allow existing wireless broadband providers to increase their service area to 20km in each fixed wireless area frequency band. please see attached documents for further information.

ComReg today publishes its market review for the fixed retail narrowband access markets. The document sets outs ComReg's findings in relation to market definition and market analysis. In addition, it imposes regulatory remedies at both the wholesale and retail level which are considered justified and proportionate. ComReg has concluded that eircom Ltd. should be designated as having SMP in the fixed retail market for lower level narrowband access to the public telephone network and in the fixed retail market for higher level narrowband access to the public telephone network.
