ComReg issues opinions of Non-Compliance

On 20 May 2020, ComReg issued opinions of Non-Compliance to Digiweb, Pure Telecom, Three Ireland, Virgin Media and Vodafone in respect of obligations under the Open Internet Access Regulation relating to a notification of a finding of non-compliance on 18 December 2019.

Since 29 November 2015, providers of internet access services have been legally obliged to ensure that any contract which includes internet access services specifies a range of information including (but not limited to):

  • A clear and comprehensible explanation of the following:
    • The minimum, normally available, maximum and advertised download and upload speed of the internet access services in the case of fixed networks,
    • The estimated maximum and advertised download and upload speed of the internet access services in the case of mobile networks,
  • The remedies available to the consumer where there is any continuous or regularly recurring discrepancy between the actual performance of the internet access service regarding speed or other quality of service parameters and the performance indicated per the above.
