ComReg, at the request of a party, may initiate an investigation into a Dispute in connection with obligations under the following Regulations and Acts:
In the event a dispute is referred to ComReg in accordance with Regulation 67(1) of the ECC Regulations and ComReg had decided that it is appropriate for it to handle the dispute, ComReg will initiate an investigation of the dispute and make a binding determination in resolution of the dispute as soon as possible under Regulation 67(2) of the ECC Regulations. In accordance with Regulation 67(3) of the ECC Regulations, ComReg has published its dispute resolution procedures, see ComReg Document No. 25/89. All investigations and determinations made under Regulation 67 of the ECC Regulations will be carried out accordance with this procedure.
In the event of a Dispute arising between two network operators in connection with infrastructure sharing, pursuant to Section 57 of the Communications Regulation Act, ComReg will initiate an investigation to resolve the dispute. In accordance with Section 57(6) of the Act, ComReg has established a Dispute Resolution Procedure see ComReg Document No. 12/108, which ComReg continues to maintain. All Section 57 disputes will be resolved in accordance with this procedure.
In the event of Dispute arising between a public communications network operator and a network operator or a holder of rights to use access points or in-building infrastructure, pursuant to Regulations 4, 5, 6, 7, 8 and 9 of the Broadband Costs Reduction Regulations, ComReg will initiate an investigation to resolve the dispute. In accordance with Regulation 11(4) of the Broadband Cost Reduction Regulations ComReg has established and published its dispute settlement procedure, see ComReg document No.16/77, which ComReg continues to maintain. All Broadband Cost Reduction Regulation disputes will be resolved in accordance with this procedure.
